Creating Your Legacy

by Bryon Swanson

Here's a little secret . . .

Estate planning doesn't have to be confusing. It's a process that is made up of three basic concepts:

  1. What do you own?
  2. Where do you want the assets to go?
  3. Who will help you "put it on paper"?

Estate planning is a means to an end. It's within your control. You make it happen. The attorneys, accountants, and financial planners simply watch out for your best interests. They work for you. They make sure your desires and intentions are accomplished.

Why Plan?

Nothing illustrates the point better than a simple story. You can probably even change the names to fit a real family that you know.

In 1991, Max and Charlotte had an average estate of $500,000. The way the economy took off during the years that followed, the assets have grown to $1,000,000. Max passed away in 1994 and left everything to Charlotte. Their two children will receive the assets when Charlotte goes to be with the Lord.

If Charlotte leaves her simple "I love you" will in place, her estate will owe $125,250 in federal taxes exactly nine months after her death.

If planning had been done prior to Max's death, most, if not all, of the tax could have been avoided. Even now, certain plans can be put into place to reduce the tax bill. And it does not have to be difficult. Do you need to find out more?

A Simple "Yes"

Can you answer "yes" to any of these simple questions?

  • Are you concerned about the impact of sudden wealth on a son or daughter?
  • Are your assets worth more than $675,000?
  • Do you own real estate outside of your state of residence?
  • Do you know someone who has had trouble settling an estate?
  • Do you own a business?

One "yes" is enough to indicate a need to do planning.
